Neinstein Personal Injury Lawyers has promoted partner Daniela M. Pacheco to head of its medical malpractice practice.

Pacheco has been with the firm since November 2014. She concentrates on plaintiff-side medical malpractice and traumatic injury litigation.

She has served as counsel in complex multi-party medical malpractice trials and appeals. She has appeared before the Superior Court of Justice and the Ontario Court of Appeal.

The Lexpert-ranked lawyer recently achieved a positive outcome for her client in KB v Guhle (2025 ABKB) before the Alberta Court of King's Bench. She was also involved in cases involving severely brain-injured plaintiffs, including Hasan v Trillium Health (2022 ONSC 3175) and Hemmings (litigation guardian of) v Peng (2022 OJ No 2674). She also achieved appeal victories in Farej v Fellows (2022 ONCA 254) and Hasan v. Trillium Health Centre (Mississauga) (2024 ONCA 586).

Neinstein described Pacheco as “a long-time leader within the firm” in a LinkedIn post. She also sits on the Ontario Trial Lawyers Association board.

She chaired the association’s medical malpractice section from May 2020 to May 2021 and was also Women's Caucus chair from May 2016 to May 2018. She received an OTLA Women's Caucus Award in 2017.

She is part of The Advocates Society, the Medico-Legal Society of Toronto, the Ontario Bar Association, the Toronto Lawyers Association, and the Women’s Law Association of Ontario. This year, the Law Society of Ontario certified her as a civil litigation specialist.

Pacheco was director of the Portuguese Canadian Lawyers’ Association over 2010-2011. She began her legal career as a lawyer at Torkin Manes LLP, where she spent over five years according to LinkedIn. She was Abrigo Centre director from March 2010 to September 2016.

She was admitted to the Ontario bar in 2010. She received her degrees from Osgoode Hall Law School and the University of Toronto.
