Social Justice: Province should make Tarion more accountable, transparent

Ontario has various laws that go a long way in the attempt to provide an element of transparency and accountability from the government.

We have legislation creating the office of the Ontario ombudsman, for example. The ombudsman has the power to investigate complaints about provincial government services.

We also have public sector salary disclosure legislation. This sunshine legislation mandates disclosure of the names, positions, salaries, and taxable benefits of public sector employees paid $100,000 or more in any calendar year. Strangely enough, there’s a huge loophole in these laws. In essence, all the government has to do is delegate a public service to a private corporation and all of the transparency and accountability laws disappear.

That’s precisely the situation with Tarion Warranty Corp., the private non-profit corporation empowered to administer and enforce the Ontario New Home Warranties Plan Act. The act is remedial consumer protection legislation designed to protect purchasers of new homes in Ontario, but the province has delegated its powers to Tarion.

The government doesn’t fund Tarion, which instead relies on mandatory fees passed onto and paid by new home purchasers as well as builder registration and renewal fees and investment income. In other words, it’s really the public that funds Tarion’s operations. Although it receives no government funding, all of Tarion’s revenue comes from its legislated mandate.

MPP Jagmeet Singh of the NDP has tabled a private member’s bill to remedy most of Tarion’s transparency and accountability problems. Bill 60, the Tarion accountability and oversight act, would bring Tarion under the jurisdiction of both the Ontario ombudsman and the auditor general as well the public sector salary disclosure legislation.

The legislation would also force Tarion to disclose all of its detailed performance-related information concerning builders. Currently, Tarion provides a builder directory with admitted deficiencies. According to Tarion, the information in the builder directory provides “some insight into a builder’s performance, but it does not represent a complete picture of their service record.”

Providing for transparency and accountability by Tarion would be no mere academic exercise.  According to a Toronto Star report, the office of the ombudsman received almost 300 complaints about Tarion from 2007-13 and ombudsman André Marin has publicly stated he has “long believed that Tarion lacks proper oversight.”

Being unable to investigate Tarion directly, Marin has reviewed the relationship between it and the Ministry of Government and Consumer Services. His 2008 report criticized the ministry for its failures concerning Tarion.

Bill 60 is the latest proposed Tarion reform. Former Ontario ombudsman Daniel Hill recommended having Tarion fall under his office’s mandate in 1986. Former MPP Rosario Marchese tabled bills to reform Tarion in 2010, 2011, and 2012.

According to Tarion’s 2013 annual report, it collected $33.9 million in new home enrolment fees in 2013. It also earned $3.2 million in builders’ registration and renewal fees. With investment income, its total revenue for the year was $71 million. Tarion paid $7.3 million “to new homeowners for warrantable claims made where the builders were unable to resolve the issues.”

Excess of revenue over expenses was $29.8 million in 2013. Total equity as of Dec. 31, 2013, stood at $216 million.

These would be stellar numbers if Tarion was a for-profit business. But Tarion isn’t a for-profit business and, aside from the numbers themselves, we have little verifiable or relevant information on whether the public is receiving value for its money or if new home purchasers are receiving fair treatment with full value for the warranties provided in the legislation.

Reforming Tarion to render it more transparent and accountable should be the starting point. With transparency and accountability, the public can assess Tarion’s accomplishments in administering its public trust, which is to protect new home purchasers. Without such an assessment, the government will never undertake reforms to protect the public.

    Tarion continues to send consumers to the LAT for resolution of new home defects caused by their builders. Consumers have neither time, financial resources, nor legal expertise to fight Tarion and its lawyers in a courtroom.
    Tarion is using warranty fund, which was meant to fix home defects, to "win" at all costs at the LAT, and shield shoddy builders from accountability if they "fully co-operate with Tarion" during the proceedings.
    The law (ONHWPA) provides new home buyers are entitled to "a home free of defects in workmanship and materials". Nowhere does it say consumers have to fight Tarion and its builders in court to get this.
    I have personally witnessed what I believe to be bullying, demeaning, and biased behaviour from an LAT Chair towards self-represented consumers. This is not a fair or balanced way to solve problems. This is not what justice system was designed to do.

Lawyers, Mountainview homes, Heron group of Companies,Marz homes, Fram building group, Empire communities, Conservatory Group of Companies, Cardel homes. Where are the public homeowners to be found on the board of directors??

    My friend bought a new house years ago. She had problems with it but Tarion would not fix it. She ended up selling the house without telling the new buyer of the problems. She was happy to get rid of the problem but she has always thought why did it have to happen to her. She paid her warranty, why did Tarion not come to help her when she was in need?

    When consumers sell a home without disclosing the construction defects, this is known as "patch and run". This is happening far too often in Canada. For example, in 2013, a "patch and run" victim in Ontario sued the original owner of the newly built and the realtor for not disclosing the construction defects. The realtor settled out of court. The second homeowner successfully sued the original homeowner in small claims court. Buyer beware!

    ADVOCATE DAILY: "The new home buyer, Manoucher Baradaran, brought a claim to the Ontario Superior Court for damages.

    Recently, the Court of Appeal found that the claim for damages, while depending on the breaches of warranty, was in fact about how Tarion and the builder handled the situation with the homeowner, and allowed the homeowner to pursue his claim.

    Ontario's citizens--indeed, across Canada--deserve better than this. There is no margin, in the larger scheme of things, in exposing new home buyers to the nightmare associated with improperly built homes: improperly built homes can make you sick; they can bankrupt the buyers trying to get them fixed; and the process has taxed many families to the point of break up. If this happened to you, would you buy another new home--ever?

    Developers may seem a mighty lot, political darlings, wielding power, putting property taxes into the hands of governments.

    That may be, but it's the new home buyers who are the economic engines--they not only buy the homes but the related expenditures are enormous contributions to the economy. They deserve the respect of said politicians.

    That respect should be demonstrated through a fair, transparent warranty program protecting them from unscrupulous builders. Governments work for us. Let's get this done.

    When your purchase a new home and the builder will not own up to their mistake where is one to go? You can ask for help from your Municipality, the Mayor, your MPP, and your MP. Then perhaps Tarion? After all, you paid for this mandatory insurance. When they refuse to help, then what do you do? Your house is no longer insurable, you cannot renew your mortgage and you will be lucky if your house is not making you sick. Bill 60 is required to make someone accountable.

    Public disclosure of this publicly funded institution is long overdue. How can a government that has been plagued by scandal, not want everyone to know how Tarion operates? Perhaps they're afraid of what might be uncovered.
    The scandal here is that the Ontario government has abdicated their responsibilities to the people of this province and left it in the hands of a private corporation. Ontarion's deserve to know if they are getting value from Tarion. Bill 60 is needed if only to make Tarion accountable to the public and not just the builders that support it.

    A True Ombudsman is needed. We do not need the current Tarion ombudsman who has a limited mandate and answers to the Tarion board of directors.

    Thirty years ago, my parents had a problem with their new house and builder. I cannot believe that today the problem still exists and is in fact worse. Building practices in Ontario have plummeted. When trades and builders know that they are not accountable, many do not care and do a shortcut job. We need Bill 60. Will Wynne only realize the problem when her kids buy a new but poorly built house or buy a "patch and run " resale home?

    It is a real failure of consumer protection principles that the Ombudsman does not have jurisdiction over Tarion. The lack of an impartial review of the corporation's practices leaves homeowners to fight their builder, Tarion, the Licence Appeal Tribunal and probably local government in order to get warrantable claims recognized. First, the homeowner has to wade through hundreds of pages of building standards, and meet Tarion's deadlines with wording for claims that Tarion accepts. The time, stress and expense, and probably the involvement of a lawyer, should never have to be experienced by a citizen of Ontario, yet the various provincial ministries who should have some oversight over various aspects of Tarion's and the builders' practices will not involve themselves, because Tarion is untouchable. This is unconscionable, and greater accountability is needed for Tarion, and, for that matter, the government.

    After having suffered first hand at Tarion's delays and tactics, I would wish upon all the board of directors' children, the suffering of all homeowners who have dealt with poor construction while in the midst of a major house move and life change. Maybe then Tarion's director's will lose their egocentric agenda of covering up for shoddy building practices.

    Bill 60 is long overdue.
    Legislated changes are needed. Tarion has not been able to self police itself. Tarion needs regulation like that of Health Professions. A home is the biggest investment in most people's lives. We need oversight by an independent body not run by self centred builders and their lawyers.
    The culture there is of protect the negligent construction and punish the homeowner for bringing it to Tarion's attention.

    The need for a watchdog is long overdue!!!
    The Tarion ombudsman is not really an ombudsman but paid for by the Tarion board of directors. Another way to dupe the public into thinking that there is accountability. In fact, the Tarion ombudsman never provides information, does not investigate throughly and delays. Ian is all sweet talk then cannot commit when you really need him.

    TWC is being run by the money collected from the warranty fees collected from all new home buyers.
    Because Tarion employs about 220 people and “the average compensation at Tarion is over $100,000 per year, with an unknown amount of that going to Tarion’s CEO, COO and nine vice-presidents.”
    Tarion earned $33million in annual revenues, ( 2013 annual Report), paid $26 million in salaries and benefits, spent $9million in administrative costs, yet paid out only $3.5 million in claims.
    Premier should dissolve this TWC with immediate effect and order a public enquiry of all Tarion inspections done till date. The TWC , warranty reps are all poorly trained and do not follow any set standard. Each rep. goes by his own set of favour guideline to builder.
    TWC is nothing but a harassment to all new home buyers and the ONHWP another Ornge in Ontario.

    Dealing with Tarion is a surprise for many homeowners who mistakenly think that Tarion will come to their rescue when something was not built correctly. Instead, people get a whack in the head when Tarion makes them jump through hoops to get something fixed instead of holding the builder accountable. The builder is the one who is laughing all the way. good builders unfortunately have their reputations as builders slandered by these unscrupulous builders.

    You give homeowners a voice to be heard above all the public relations work done by Tarion about how it is protecting the public. Tarion likes to protect its true mandate of aiding developers and builders. Tarion collects its funds by mandatory fees from homeowners. What a great thing it would be if Tarion actually spent the money on helping homeowners instead of hiring lawyers to fight them.

    Thank goodness this is finally coming to light. The home purchasers have been suffering too long while the builders just laugh all the way to the bank. Tarion is supposed to be representing the purchasers who are often making the largest purchases of their lives must be protected and Tarion must be accountable and transparent to those who are funding them...the home buyers.

    Tarion, a horrendous company that has been allowed to operate in an obvious position of conflict of interest. Dealing with Tarion is actually worse than the home deficiency itself. They put so much stress in our lives I can't begin to explain. One thing is absolutely 100% accurate...'THEY DO NOT WORK ON BEHALF OF HOMEOWNERS'!! They fight homeowners at all cost. Their legal depart are simply pathetic (not bright), threatening and never allow FACT to get in the way of a claim. It cost us ten of thousands $ in lawyers to try to have Tarion honour our warranty. Tarion will not return the money they FORCED us to spend that was not needed! The ENG reports were clear, they still fought us tooth and nail. Pathetic in every way imaginable. No conscience, how anyone gets up in the morning, looks themselves in a mirror and works for this company is staggering. Knowing they are lying and cheating people in desperate situations is ridiculous!

    Bill 60, the oversight of Tarion, is long overdue. Consumers, who have made the largest purchase of their lives need warranty protection coverage set forth in the Tarion mandate. Sadly, the PR rhetoric provided by Tarion is NOT the service they provide. Fighting homeowners every step of the way, to provide protection for clearly warrantable items seems to be their mandate. Thousands of Ontario consumers have been denied coverage by the ungoverned juggernaut known as Tarion Warranty Corp.

    How much were the total claims?

    Bill 60 is long overdue. Tarion must be held accountable, their warranty is an absolute joke. They argue even structural deficiencies as per their rules if it is not causing damage it is not a problem, the same is for OBC violations; not causing damage it is not a problem. So wonder why unethical builders like mine not following engineering designs if they can save money while Tarion's got their backs!!

    Ray & Joyce over the last 10 years have had an ongoing uphill battle with Tarion.
    Tarion is a self serving Bureaucracy that buries the home buyer in philosophical rhetoric, and red tape over an extended period of time. All of which makes curtain that the home buyer is extremely likely to give up, and or otherwise fail. How many times is too many to be cleaning up the mud and water as shown in the picture below 7,8,9 times?

My hope is that every taxpayer will be convinced that TARION must be transparent and accountable.     I spent many years down the rabbit hole of Tarion - a place where up is down and down is up. They are masters at putting roadblocks in the way of resolving consumer complaints and when the consumer runs out of mental and financial resources and gives up, Tarion calls that a successfully resolved complaint. All of this aided and abetted by the License Appeals Tribunal, where everyone in the room, except the consumer, is paid and/or a lawyer.

    Where is the 'transparency in builder track records' Tarion as industry regulator is supposed to provide? It seems builders who 'fully co-opeate with Tarion at the LAT' get in return these defects NOT listed on their Tarion records. Who does this benefit? The oversight Ministry is 'working with Tarion' on this, and Tarion is 'working with the Ministry' on this. Together they don't seem to be able to disclose anything close to accurate builder track records. Even the LAT website has removed LAT cases from its own website. Who does this benefit? In all of the above, the consumer ends up with the short end of the stick. No wonder Premiers Wynne/McGuinty have consistently refused to meet with consumers to discuss these important consumer protection issues. This only shields shoddy builders from accountability. Who does that benefit?

    Bill 60 is long overdue and it is about time to hold Tarion accountable. They are a government inside a government and no one has power over them. If our government don't perform we can simple not vote again and change them every 4 years, isn't it about time to REFORM Tarion after almost 40 years of bullying homeowners and supporting shoddy builders?

    Thank you for article and recognizing this very big problem! As one of the many hundreds of home owners that have builder and building issues both Tarion has denied and builder has refused to fix even at Tarions directive, I feel Tarion has failed us and the government has also failed us not passing Bill 60 asap. Wynne ignores the issues. So who is protecting who? Who loses their life savings, we do!
    Tarion needs to be accountable!

    Bill60, re oversight of Tarion is needed. Consumers, who have made the biggest purchase of their lives, assume they have warranty protection when defects are found. They are sadly mistaken. Tarion will and does use unheard of legal tactics to deny claims, and ultimately side with the builder in the process. Tarion twists the true meaning of the ONHWP Act to achieve the denials of claims, using "experts" that, most times, don't even attend the home to view defects first hand. If one appeals to the LAT, the LAT has no power to force Tarion or their member builder to rectify any defects, they are usually just ignored. People have lost their homes to foreclosure, due to 4-5 year outstanding Ontario Building Code violations, some of which were directed by Tarion field reps, as a temporary "fix". I applaud MPP Singh, CPBH, Rosario Marchese, Consumers Reform Tarion, and Make Tarion Accountable, and all others, who wish to see Bill 60 passed, to provide oversight to this un-governed juggernaut

    Bill 60 would have helped my fight in 2013. I am hopeful that it will be helpful for my children as I would hate for them to endure this battle like I am fighting. When Corporations are paid to fight and that is their job it does not compare to the fight of the single parent, the family that struggles to find time for one another in the first place. This time consuming, long, drawn out process that can be mediated without the LAT is not. The deep pockets that we put our hard earned money into is being used against us. Bill 60 is needed desperately and the time is now to start meaning accountability and a time for change. I thank Mr. Shanoff and all those in helping to shed light on this system of inequality.

    However, beyond these structural deficiencies, there is an absolute urgent requirement to change the entire modus operandi of Tarion starting with the Homeowner Information Package and going down into the trenches when the homeowner faces the Tarion inspectors!

    Like everything else there should be something in place where homeowners going through the process can get "referrals", so to speak, from previous homeowners. Contacts are the hardest thing to find and there needs to be a directory of sorts that can list homeowners issues that were denied so other homeowners can gather their information and not be left ignorant in this process. It is unfair to navigate this process without help and resources.

    There are many excellent builders but one role of gov't is to protect the general public from those who are less than scrupulous. Accountability is key in such matters as this. Tarion must have the defined criteria and a good set of teeth to support of the government mandates. The construction industry has the potential to govern itself but it has not done so in the past. Hence 'speak softly and carry a big stick' would be an appropriate mantra. Perhaps the home warranty insurance should be a private insurance company? Just a thought?

    Ciro, you make excellent points. There are many good builders in Canada, but consumers have no reliable way of knowing who they are. In Ontario, there are also Tarion-approved marginal and poor builders. Consumers continue to advise that the builder performance records on the Tarion site are inaccurate.

    We also wonder why the building industry has not done a much better job to ensure all builders at least meet the minimum applicable codes. CPBH just wrote to the Canadian Home Builders Assoc. again last weekend. It has "consumer protection" as one of its services and we have asked what that entails.

    Some provinces such as Manitoba and Alberta offer multiple warranty providers. CPBH has been on record for many years now saying that Tarion's monopoly should be removed. But we have found no appetite yet at Queen's Park for that. CPBH believes Bill 60 is a reasonable compromise and fully supports it.

    This legislation is overdue - new home buyers have suffered for years under illusory "protections" offered under the ONHWP and now Tarion banners. To be blunt its dysfunctional and the builders like it that way. Its process is filled with procedural traps for the neophyte buyer and for any buyer with the guts and desire to push back, the builders use expert counsel well versed in the dimly-lit "authority" that is available - almost all of it anti-buyer. If they really want to fight, a buyer goes to the ill-suited Licence Appeal Tribunal or LAT, the same body where one appeals the denial of a hot dog cart licence. Here they'll find more woe and a dismal sub-10% purchaser win rate. If you aren't broke or crazy yet, a harder push lands you at Divisional Court - which is of course an appeal not a trial de novo - and again you face the unhelpful web of cases which contain few buyer-friendly ratios. Really bad protection is worse than simply being allowed to sue in civil court! Fix it!

    Consumers and taxpayers deserve decent and timely service during the Tarion warranty administration process. The existing warranty through Tarion is not transparent and unfortunately is geared towards delaying and dismissing warranty claims. Tarion and the License Appeal Tribunal which has been designated to appeal Tarion's decision should be treating home buyers as the those they are trying to protect and not someone they are trying to defeat. We deserve and need better protection from dishonest builders.

    ...ditto across the nation! Since the feds divested of their responsibilities in the 80's to the provinces, homeowner protection has continued to go downhill ever since. Since those same 80's, industry on a global basis has adopted quality standards and practices that produce zero defects, or defects measured in parts per billion. The Canadian building industry however still fails to build to the antiquated minimum standards of the Building Code. The focus needs to be turned on the root of the problem; why do we need home warranty insurance anyway?

    Tarion is the only Delegated Administrative Authority in Ontario that can make their own regulations. Consequently this unchecked authority has allowed Tarion to further water down the protection for new homeowners over the years.

    There are no consequences for Tarion in the ONHWP legislation if they violate the ONHWP Act or the regulations they have made. In regards to the Builder Directory Tarion makes deals with Builders that claims will not end up on their record if they co-operate with Tarion to defeat homeowners appealing their decisions at the License Appeal Tribunal.

    I am glad there are people willing to speak out and educate others about this serious issue before themselves or someone they know and care about will need this protection. I hope our MPPs including the Liberal ones will keep this in mind when Private Member’s Bill 60 comes up for a vote and they need to vote in their constituents best interest.

    Thank you Alan Shanoff for continuing to shed light on the challenges that consumers have with Tarion. No accountability, no transparency, a government mandated monopoly. I used to believe this only happens in Communist or Dictatorship countries. Obviously Ontarians need - and deserve - much better than this.

    Thank you to Mr. Shanoff for this very important article. Canadians for Properly Built Homes (CPBH) agrees that the Province of Ontario needs to make Tarion accountable and transparent. CPBH fully supports Bill 60, the Tarion Accountability and Oversight Act, introduced by MPP Jagmeet Singh.

    The horrendous Tarion situation ( the Tarion Way to use a self defined term off their own website ) is finally explained in all the intricacies, complex legalities and unimaginable twists and turns that have allowed it to survive too many decades . It takes years of investigation and research, an understanding of the current " system " , its history and loopholes coupled with real people with a true concern for social justice in all disciplines of life including the simple consumer who has been subject to the Tarion way , to pull all the pieces together into a comprehensive whole for public view and reform .
